2012 INTERNET AND E-COMMERCE LAW (LSSICE)

AND DATA PROTECTION (LOPD)

Following publication in the BOE [Boletín Oficial del Estado - Spanish Official State Gazette] of the Spanish Royal Decree-law 13/2012 of 30th March, changes have been made to the Spanish Act (LSSICE) [Ley de Servicios de la Sociedad de la Información y del Comercio Electrónico - Spanish Act regarding Information Society Services and Electronic Commerce] of 2002, which affects the use of cookies and commercial messages sent by e-mail.

With this Royal Decree, several European directives are transposed and Spain, along with all member States of the European Union, adapts to the European Directive 2009/136/EC "regarding the processing and retention of data and the protection of privacy in electronic communications".
